Telangana RERA Invokes Force Majeure; Grants 4-Month Extension to Real Estate Projects

Introduction:
Those familiar with Section 6 of the RERA Act will know that it provides for the extension of project registration in the event of Force Majeure. Against this backdrop, and following a recent advisory from the Ministry of Housing and Urban Affairs (MoHUA), the Telangana Real Estate Regulatory Authority (TGRERA) has issued an order granting a four-month extension to eligible registered real estate projects. The order covers projects whose completion date, revised completion date or extended completion date falls on or after 28 February 2026, with the prevailing West Asia situation being treated as a “war” for invoking Force Majeure.

Sub: TGRERA – Extension of registration of Real Estate projects affected by the prevailing West Asia situation, treating it as “war” for the purpose of Force Majeure under the provisions of the Real Estate (Regulation and Development) Act, 2016 for a period of four months after 28.02.2026 – Orders – Issued.

The Government of India, Ministry of Housing & Urban Affairs (Housing Division), vide reference cited above, has advised all Real Estate Regulatory Authorities that, in exercise of the powers conferred under the provisions of the Real Estate (Regulation and Development) Act, 2016, they may issue suitable orders or directions for the grant of extension of registration and corresponding completion timelines of registered Real Estate Projects whose completion date, revised completion date, or extended completion date falls on or after 28 February 2026 for a period of four months, treating the West Asia situation as a “war” for the purpose of invocation of the Force Majeure clause.
In view of the above orders, and in terms of Section 6 of the Real Estate (Regulation and Development) Act, 2016, read with Rule 6 of the Telangana Real Estate (Regulation and Development) Rules, 2017, this Authority hereby issues the following orders:
“The validity of registration and corresponding completion timelines of registered Real Estate Projects under TGRERA, whose completion date, revised completion date, or extended completion date falls on or after 28 February 2026, shall stand extended for a period of “four months.”
Explanation: For the projects whose completion date, revised completion date or extended completion date falls between 28th Feb 2026 and 31st July 2026, the completion timelines shall stand extended up to 30th Nov 2026.
It is further ordered that there is no requirement for the submission of separate individual applications or the payment of any fees for this extension.
